nbc bay area's chief investigator broke the story at 6:00, and joins us again tonight. what's the legal strategy here. >> sources tell us this is a major development, in something that's been in the works for good. getting a death penalty becomes more difficult. now, experts say the new charges strengthen the case against the man accused of killing sierra lamar. >> this was a big break in their case. >> the three new charges accused torres of attempted kidnapping during the commission of three separate carjackings, according to the sarn ta clara county district attorney there were three separate victims, three other girls targeted when garcia torres was under the age of 18. >> this new evidence and these new charges bolster the d.a.'s theory that garcia torres is a violent predator capable of murder. >> nbc bay area has learned that

all of the attacks happened in march of 2009 and one involved the use of a taser. >> i'm sure the reasons for me doing what i'm doing are readily apparent to the defense. we're here to -- we believe we can prove conduct to hold the defendant accountable for everything he's done. >> we know their paths have crossed. the defense is going to say, that doesn't equal murder. the d.a. is going to say, this man is capable of kidnapping, carjacking and capable of murder. and the jury, if they hear about this, they're likely going to agree he's capable of such an act. >> the latest legal move by the d.a. sets the stage for a contentious trial. >> they're very serious charges in and of themselves, you could do multiple years in prison on

what happened. there was an event happening at the time. there were some evacuations. from what we hear so far, no one was hurt. when we have new information on this we'll bring it to you immediately. an apology and pledge to do better. in the midst of a sexual abuse scandal and three lawsuits. the school board voted to revise its child abuse and prevention policy. the vote came after an emotional apology to the victims in the case. nbc bay area's jean ellie is live with more. i hear it was a gust wrenching meeting? >> members of the school board have been quiet about this scandal until now. and tonight members apologized for the abuse and for its reaction to one of the lawsuits. they also adopted changes they hope will better protect students. >> i can't tell you how sorry we are to the -- to what happened.

>> an emotional apology to a former student and two other sexual abuse victims known only as jane doe one and two. teachers in the district sexually abused the middle school girls in the '90s. documents proved school staff knew the girl was being abused but no one acted to stop it. >> we hurt people and i wish we could take it back. >> the district laid out defe e defense -- in part, the girl was responsible for her abuse. the president of the school board resigned. the board said all three victims are now agreeing to mediation. the district hopes to reach a fair resolution. his supporters say they hope the 30-year-old's bravery teaches the district a painful lesson. >> i hope -- the district and

the people who are still in place, need to feel the heat of punishment of what they allowed to happen. >> reporter: with three sex abuse cases on the table, they're demanding changes. >> there's nothing we can do to take away the pain. i guarantee you they would do anything to make sure that doesn't happen again. >> the board did vote tonight to make every staff member a mandatory reporter, it's also increasing staff training and plans to do a survey to find out how they can make reporting suspected abuse easier. reporting live in the east bay, jean ellie, nbc bay area news. >> thank you, jean. a serial rapist who preyed on women in san francisco's mission district could spend the rest of his life in prison. frederick dozier was convicted on three counts of sexual assault just last year. he would grab the victims from

behind and drag them to secluded areas. the only count the jury did not convict him up was attempted murder. >> detectives believe it was a random but calculated attack. tonight they need your help in finding the men behind the brazen kidnapping. police want you to take a good look at these surveillance photos of the man who goes by the name aubrey. he and a second man who goes by the name david are accused of kidnapping and carjacking a 57-year-old woman from outside of her job last wednesday. the woman was tide up, blindfolded and forced to withdraw money at east bay atm's. ultimately she was driven to an isolated area in oakland where she was let go. >> she did have some minor injuries, most came from being bound and gagged. she needed some stitches after the suspects tried to remove some of her valuables. >> this is where you come in, if

you recognize this man. police in walnut creek would like to hear from you. >> it's a bizarre international story about a silicon valley millionai millionaire. police are urging john mcafee to come in for questioning to help solve the murder of his neighbor. the 67-year-old mcafee is considered a person of interest in the weekend shooting of 52-year-old gregory fall. this happened in belize. mcafee told cnbc today i've been accused of something i didn't do. i'm moving every four hours and i'm fearful for my life. in 1987, mcafee started the anti-virus software company which bears his name. there's no danger of another mudslide in daily city tonight. a pipe attached to a 978,000 gallon water tank ruptured around 4:45 this morning. 45,000 gallons of water just went rushing down the hillside park area and flooded several blocks. homes were evacuated for a short

for years, nancy pelosi has been one of the most influential politicians in the country. tomorrow she may step down. she was elected to her 13th full term in the house of representatives. in the past few years she's been vilified by republicans. the outspoken democrat maybe a hindrance for president obama as he works with republicans to solve the looming fiscal cliff.

she will announce her decision at 7:00 a.m. oakland p.d. officers have a new creed after coming to the rescue of a mother in labor. tonight a reunion with a small recruit and a baby cam that shows how the men in blue stood and delivered. is there a code for a baby on the way? >> i don't think so. and as you know, i cover a lot of stories in oakland. and i've seen these particular officers in different situations. but seeing these officers gush over this baby boy was special. >> i would like to present barry with baby nolan's first official police badge. >> a police badge a bag of goodies and a stuffed animal. three oakland police officers got their first glimpse of a baby boy they helped bring into the world friday night. barry miller, the baby's dad

explained what happened. >> got home, a couple blocks, i walked a couple blocks home. when i got in the house, she said she was hurting. >> when they jumped into their car with their 4-year-old son, mom kimberly said she wasn't going to make it to the hospital. >> he was really trying to get on the freeway, and i just knew if i would have had him in the car i would have panicked. i was already in the state of panic. >> barry says he was in panic mode too. he stopped at this shell gas station on golf links road near the 580 freeway. the three officers just happened to be there. surveillance video shows them running to the car. >> i remember asking dad, dad, do you have any towels, anything to wrap the baby in. he said no. >> he quickly took off his shirt to use as a blanket. >> on that day when she told us she was having the baby, she was not lying, she was having a baby. >> jeffrey sid took the lead. he's trained to protect and serve. this was not a normal day.

>> we were able to check and the baby was crowning. so then i turned to charles. i remember telling charles, this baby's coming, charles. >> just minutes later, baby nolan arrived. >> if it weren't for these three officers, no matter what they were doing, that was just -- these three guys, it was always going to be a blessing to me. no matter what happens. you saved my son's life. >> reporter: a very emotional day for everyone involved. now, baby nolan is named after nolan park. of course, he was born across the street. his middle name is shell after the shell gas station. baby and mother are doing fine tonight. reporting live in east oakland, cheryl hurd nbc bay area news. >> what an incredible story. it's good for shoppers looking for a bargain, not so good for workers. employees are unhappy about the new black friday hours for

target and many other stores, next week's bargains actually begin on black thursday which is thanksgiving night. it's the earliest the store has ever kicked off its holiday sales. workers started a petition with 180,000 signatures and counting. a target spokesperson told nbc that employees receive time and a half pay for working holidays, and some employees are excited for the chance to grab extra hours. we all know they provide shade and a sense of serenity, did you know trees could change the value of your home and the safety of your family? stephanie troung shows how tree cover could change your neighborhood. >> reporter: the trees along the street, the ones you walk and drive by every day, may affect your life more than you think. >> one day -- >> reporter: just ask this man who made it his mission to bring trees to his san jose

neighborhood. it started with his neighbor. >> super bowl sunday 1998 she came home, police cordened off the area because of a shooting. >> reporter: they decided to focus on beautifying their street with the help of a local nonprofit. >> we planted 65,000 large trees in the last 15 years. >> reporter: and in winn's neighborhood, the effect was lightening-fast. >> i would see people intentionally staying and improving their house. >> reporter: an increase in property value is what u.s. forest service economist also found. he's published multiple studies on trees and their impact on the neighborhood. >> having the tree outside increased the price of your home by $6,700. >> that was the obvious question. >> what surprised me is the profound effect it can have on things like crime or health. >> smaller trees were linked to higher crime, larger trees seemed to cut down on crime and donovan's study based in

portland oregon. >> they signal to a potential criminal that a neighborhood is well cared for. should they commit a crime, they would be more likely to get caught. >> reporter: mark lives near 101 in san jose. he said back in 1990 -- planting a few hundred trees has wiped out any and all graffiti. once staining the walls of houses and apartments here. >> less activity than i have with gang members. >> reporter: and it helped calm traffic. >> there are as many as half fewer car accidents along tree-lined streets. >> reporter: for donovan, the biggest find of all, the benefit to your health, beyond better air quality. >> women who lived in houses that were closer to open space or a tree canopy within 50 meters of their house were less likely to have underweight babies. it reduced stress, which improves the birth outcome. >> the power of trees isn't just a numbers game. you can see it in these google images. trees seem to define the lines

hour, can you see clear skies with the city lights twinkling bright. we have a little bit of cloud cover that will make its way in for the morning hours. not expecting a major fog event as you start off wednesday morning. we have active weather coming our way. high pressure that brought us all of that sunshine today. you enjoyed moving off to the south. we'll get milder weather to stay with us for wednesday. by thursday, here comes that area of low pressure. it's not only going to increase the cloud cover, but eventually it's going to push in some rainfall in the seven-day forecast. for wednesday, sunny skies across the peninsula. south bay, 60s and 70s. by thursday, gradual cooling as eventually we'll starts to usher in some raindrops. we have at least one more day as we've been mentioning of sunny skies. it will mean some near record setting heat in oakland, we're forecasting the record 72. it's possible we'll tie a few records for tomorrow. it's not going to be hot, it will be enjoyable. that's how it looks when you look at the numbers overall.

as we head throughout thursday. cloud cover's going to be on the increase. by 7:00 p.m. on thursday, everyone's expecting cloudy skies. then as we head throughout friday. that's the next point here, that we expect those raindrops to start to push in here, and what's going to be different about this storm system that almost every other storm system we see across the bay area, the rain will move across the south and then push off to the north. at this point all forecast models looking toward friday morning with raindrops first in the south bay, then pushing off to the north. nonetheless, it will be much needed rain coming our way. not as cold as it has been the last few nights. plenty of upper 30s and low 40s for the bay. daytime highs on wednesday will be enjoyable. close to 80 in fairfield. also close to 80 in gilroy. mid-70s in san jose and santa rosa. we were at safeway today helping to kick off our annual food drive. you guys were awesome today.

really getting it kicked off. you can pick up these $10 prefilled bags through the next few weeks. we're looking to break the half million dollar goal last year and surpass. all have you to do is head out, you can meet plenty of employees from nbc bay area. now, friday rain returns, we could see a quarter inch of rain. and then another storm system by sunday, much colder air as well, where we could see an additional quarter to a half inch. two decent storms coming in the next 7-day forecast. we could have a third system next week, it's not even on the seven-day forecast by next wednesday. very happy person back in the weather center. >> he had fun. >> he did. >> the honorary principal here. >> call me a cheerleader earlier. >> no, i said head of the cheer squad. >> i'm happy to be that too. >> no delay this year by the way. the local crab season begins thursday, there's a catch. we'll explain next.

crab season starts this week, if you love crabs you're going to have to pay up. crab seasonal was delayed until after thanksgiving because of a price dispute. not this year, yesterday fishermen and processors settled on a wholesale price a pound that's 75 cents more than last year. it's the beginning of what could be a bitter debate about san francisco's waterfront. tomorrow is a big step for the newly proposed basketball arena for the warriors. the committee is expected to approve the start of the review. mayor lee and the warriors plan to make what they call a major jobs announcement regarding the proposed arena. we're back in a moment with sports. credited bob melvin for all of the team's success. the baseball writers agreed, they voted melvin the american league manager of the year. >> well, you know it ended so suddenly, it was a disappointment. we thought we were going to win and we thought we were going to the next series. it was kind of a shock to our system that we didn't win and the season was over, it ended so suddenly, and you go back, and you're kind of struggling with the fact that you -- emotionally, you felt you should go a little further. and then probably after a week you start to reflect about where you were as an organization when the year started and what we accomplished in doing what we did this season. and getting to the point we did. and you start to feel pretty good about some of the strayeds and some of the things we did to get there. >> well, let's stick with baseball. davey johnson was named the national league manager of the year. remember the votes are turned in before the postseason. johnson led the nationals to the

playoffs for the first time since the franchise moved to washington, d.c.. what about the marlins, their shortstop jose reyes is headed to toronto, along with josh johnson and mark buehrle in the latest fire sale by the marlins. they spend over 200 million dollars last winter and have moved all of the players they signed to very big contracts. pepperdine visiting cal on the hardwood, late first half cal up 3. ricky gets the loose ball. cal up by 10 at the break. second half, crab hits his fourth three-pointer of the game. he had a career high 34 points on the night. cal wins big. over on the gridiron, stanford is gearing up for their showdown with second ranked oregon. saturday night in eugene, they know they have their work cut out for them taking on the undefeated ducks at home.

crews took down an 80 foot tall norway spruce to be this year's rockefeller center holiday tree. the tree was picked a month ago in an area of new jersey that was hammered by super storm sandy. >> the tree lighting is scheduled to take place on november 28th. >> the holidays are here. >> they are. >> rushing toward us. thanks for joining us
